A Munich court has ruled that OpenAI’s ChatGPT violated German copyright laws by using protected lyrics to train its language models, marking a significant decision for the creative industry. The ruling favored GEMA, Germany’s music rights society, which argued that ChatGPT illegally harvested lyrics from notable German songs, including Herbert Grönemeyer’s “Männer” and Helene Fischer’s “Atemlos Durch die Nacht.” GEMA, representing around 100,000 members, initiated the lawsuit in November 2024 to combat unauthorized AI scraping of artistic works. The court ordered OpenAI to pay undisclosed damages and noted that AI operators must comply with copyright law. GEMA views this as a landmark ruling that could influence future copyright cases across Europe, asserting that human creativity deserves protection. OpenAI indicated plans to appeal, emphasizing its commitment to respecting creators’ rights while continuing to engage with stakeholders globally.
