A federal judge has ordered OpenAI to disclose internal communications related to the deletion of two significant troves of pirated books from a notorious “shadow library” used for training ChatGPT. Manhattan Federal Court Magistrate Judge Ona Wang determined that OpenAI’s inconsistent justifications for deleting the datasets void the claim of attorney-client privilege. She emphasized that OpenAI’s argument about its good faith in copyright matters must be transparent for the jury. The ruling is part of a class-action lawsuit involving major plaintiffs, including the Authors Guild and authors like George R.R. Martin and John Grisham, alleging copyright infringement due to OpenAI’s use of books from the “LibGen” library. OpenAI had previously stated the deletion was due to “non-use,” yet shifted its stance during the discovery process. The judge’s order compels OpenAI to provide relevant communications, further intensifying scrutiny around AI training practices. OpenAI plans to appeal the decision.
