Enhancing Global Majority Judicial Systems with AI: Insights from the Stimson Center

Since 2023, Microsoft’s Office of Responsible AI has collaborated with the Stimson Center to explore AI implications in emerging markets, specifically within judicial systems. A UNESCO survey highlights varied awareness among judges, with 92% familiar with AI, yet only 31% highly knowledgeable. AI applications, such as document drafting and case management, are increasing, yet half of judges abstain from professional use. The integration of AI in the judiciary is categorized into clerical assistive systems, recommendation systems, and semi-decision-making systems. Challenges include potential biases, privacy concerns, and a risk of legal stasis, where AI may stagnate legal evolution. Conversely, opportunities exist for improving efficiency, accuracy, and access to justice, particularly through administrative task automation and enhanced case management. However, judicial independence is paramount; judges must verify AI outputs to mitigate risks associated with misinformation and overreliance. Ultimately, maintaining transparency and public trust is essential in integrating AI responsibly within the judiciary.
