Two recent rulings in the U.S. and UK underline the legal risks associated with using Generative AI (Gen AI) tools for legal tasks, particularly concerning legal professional privilege (LPP). In New York, a court ruled that documents generated by an AI chatbot lacked protection under attorney-client privilege, as communications with the chatbot weren’t deemed confidential and didn’t constitute direct attorney-client interactions. Similarly, a UK Tribunal cautioned against inputting client documents into open-source AI tools, emphasizing that doing so breaches client confidentiality and waives legal privilege. To mitigate these risks, in-house lawyers should understand the data usage policies of Gen AI tools, prefer closed-source systems for confidential tasks, and be mindful of cross-border litigation considerations. Both cases highlight the importance of safeguarding LPP when utilizing AI technologies. Legal professionals are urged to stay vigilant and review AI tool terms to protect sensitive information effectively.
