Similarly, a UK Tribunal cautioned against inputting client documents into open-source AI tools, emphasizing that doing so breaches client confidentiality and waives legal privilege. To mitigate these risks, in-house lawyers should understand the data usage policies of Gen AI tools, prefer closed-source systems for confidential tasks, and be mindful of cross-border litigation considerations. Both cases highlight the importance of safeguarding LPP when utilizing AI technologies.
