Elon Musk has initiated a lawsuit against OpenAI and Microsoft, seeking up to $134 billion for alleged “wrongful gains” linked to his early contributions to OpenAI. In a federal court filing, Musk claims he provided approximately $38 million, constituting around 60% of OpenAI’s initial funding, and played a crucial role in recruiting staff and enhancing the project’s credibility at its 2015 inception. After leaving OpenAI in 2018, Musk founded xAI, a direct competitor to ChatGPT. He estimates that OpenAI profited between $65.5 billion and $109.4 billion, while Microsoft reaped $13.3 billion to $25.1 billion from his investments. Musk seeks to recover these earnings and may pursue punitive damages. OpenAI has dismissed the lawsuit as “baseless,” while Microsoft denies any wrongdoing. A jury trial is slated to commence in April 2026, following a recent ruling in Oakland, California.
