In response, OpenAI stated that while it includes safeguards, these protections are less effective in long interactions. The case is notable as it marks the second lawsuit linking AI chatbots to a young adult’s death, with a similar case ongoing in Florida concerning a Character.ai chatbot. A critical aspect of OpenAI’s defense may involve Section 230 of the Communications Decency Act, which typically shields platforms from liability for user-generated content.
