Lawyers representing the Daily News, The New York Times, and other media organizations are urging a Manhattan judge to reject OpenAI’s request to continue deleting data pertinent to a lawsuit accusing the company of copyright infringement. A judge previously ordered OpenAI to preserve output logs, citing concerns that the deletion could hinder the newspapers’ ability to prove that the AI technology bypasses paywalls and reproduces copyrighted material. OpenAI argues that retaining data poses a significant burden and privacy risks. In response, the news outlets assert that the data is relevant to their infringement claims and accuse OpenAI of employing tactics to evade accountability, including deleting pertinent data and implementing filters that obscure journalists’ work. The newspapers maintain that OpenAI has illegally sourced their content and that the company’s fair use defense is unfounded, emphasizing the need for transparency in addressing these copyright issues. The case was initiated in December 2023.
