Wang’s order, issued on October 9, relieves OpenAI from the obligation to preserve “output log data” going forward. This case began in late 2023 when the New York Times sued OpenAI for copyright infringement, alleging that the AI company utilized its material without compensation. Initially, OpenAI was mandated to retain all chat logs for investigation into these claims. OpenAI contested this, citing risks to user privacy. The recent ruling allows the company to stop preserving future chat logs as of September 26, but it must retain data linked to flagged ChatGPT accounts. The NYT can also expand the list of flagged users while accessing the previously preserved records.
