OpenAI Inc. faced another setback as Judge Sidney H. Stein denied its request to overturn a data preservation order related to a copyright case involving the training of its AI, ChatGPT. During an oral argument, the judge supported Magistrate Judge Ona T. Wang’s ruling, emphasizing that it is reasonable to infer that some users might wish to delete their data to avoid potential copyright infringements. Wang initially issued the order in May, and her subsequent denial of OpenAI’s request for reconsideration reaffirmed the requirement to maintain all ChatGPT outputs from user interactions for the plaintiffs.
