As India prepares to host the AI Impact Summit 2026, the Supreme Court has raised concerns about the misuse of artificial intelligence in legal practices. Chief Justice Surya Kant highlighted alarming trends where lawyers use AI tools for drafting petitions, leading to the inclusion of fabricated case citations like ‘Mercy vs Mankind.’ The bench, which includes Justices BV Nagarathna and Joymalya Bagchi, noted that such practices burden judges and undermine the integrity of the legal system. Justice Nagarathna pointed out that while some citations may exist, they often contain inaccuracies, exacerbating challenges in verifying legal claims. She expressed concern over the declining quality of legal drafting, as petitions frequently consist of extensive quotes from previous judgments with minimal original content. Overall, this situation raises significant questions about the reliability of AI in legal contexts and the need for guidelines to address these emerging challenges.
