The U.S. Patent and Trademark Office (USPTO) is launching an “Automated Search Pilot Program,” using artificial intelligence (AI) to enhance the patent application process by assessing “prior art” issues. As announced on October 8, this pilot aims to provide earlier communication to applicants regarding potential prior art before their applications undergo substantive examination. The USPTO will accept up to 1,600 patent application petitions starting October 20, 2025. The initiative seeks to improve examination quality and efficiency by supplying relevant prior art that can aid applicants in making informed decisions. The internal AI tool utilized for this program scans publicly available documents, ensuring data security and confidentiality.
