AI porn startup sues Apple over App Store takedowns, claims $500,000 in lost revenue

AI startup Ex-Human has filed a lawsuit against Apple for allegedly unlawfully removing its apps, Botify AI and Photify AI, from the App Store, claiming it resulted in a $500,000 revenue loss. The San Francisco Business Times reports that Ex-Human’s apps remain available on Google Play and partner platforms like Grindr. The lawsuit alleges that Apple failed to provide substantial evidence for the removal, only citing “dishonest or fraudulent activity.” Ex-Human argues that Apple’s actions aim to suppress competition against its own Image Playground feature. This controversy escalated after an MIT Technology Review report highlighted moderation issues with Botify AI, noting that chatbots offering explicit content were inadequately filtered. Additionally, Photify AI has faced scrutiny for generating images of individuals without consent. Ex-Human claims its apps had superior user engagement compared to competitors like ChatGPT, with Botify generating monthly revenues of approximately $330,000.
