Ex-Human, an AI start-up, has filed a lawsuit against Apple, alleging wrongful removal of its apps, Botify AI and Photify AI, from the App Store, resulting in a loss of approximately $500,000 in revenue. The company argues that these actions were intended to stifle competition against Apple’s own features, like Image Playground. Ex-Human claims that Apple’s removal notice lacked specific evidence of “dishonest or fraudulent activity.” Despite the controversy surrounding its chatbots and issues with user-generated content, both apps remain available on Google’s Play Store. The lawsuit highlights that Ex-Human’s AI holds higher user interaction rates compared to competitors such as ChatGPT. Additionally, reports indicate Ex-Human had previously been recognized as a ‘high-growth developer’ by Apple, with revenues of $330,000 from Botify AI and $100,000 from Photify AI per month. The case raises significant concerns regarding app marketplace fairness and transparency in app removal practices.
