IndiaMART has filed a lawsuit against OpenAI in the Calcutta High Court, alleging unlawful exclusion from ChatGPT search results, resulting in reputational and commercial harm. The case, IndiaMART InterMESH Limited vs. OpenAI Inc., highlights claims of selective discrimination, as IndiaMART’s listings were omitted while competitors continued to be featured. Justice Ravi Krishan Kapur recognized a strong prima facie case for IndiaMART, noting that this exclusion might lead to significant commercial injury and loss of goodwill. Despite this, the court denied immediate relief, citing the absence of representation from OpenAI. IndiaMART argues that the exclusion constitutes trade libel and unfair competition, asserting it was unfairly highlighted in a U.S. Trade Representative report without an opportunity to respond. The matter, listing several other companies unfairly treated, raises critical questions regarding fair practices in AI-generated content. Further hearings are scheduled for January 13.
