Nielsen’s Gracenote has filed a federal lawsuit against OpenAI, alleging unauthorized use of its copyrighted movie and TV show metadata to train ChatGPT. This lawsuit, lodged in Manhattan court, seeks monetary damages and an injunction to prevent OpenAI from leveraging Gracenote’s proprietary content. Gracenote, known for its detailed entertainment data, claims that OpenAI appropriated its protected resources to generate similar content descriptions and identification tags without proper authorization. An OpenAI spokesperson defended their data usage, emphasizing that their AI systems “empower innovation” and are based on publicly available data under fair use principles. Gracenote’s CEO criticized OpenAI’s actions, asserting they exploited decades of proprietary work without consent. The lawsuit could severely impact Gracenote’s revenue from licensing agreements with media distribution companies, as it also notes the AI’s ability to reproduce Gracenote’s exact descriptions for popular shows like “Breaking Bad” and “Game of Thrones.”
