The Gujarat High Court recently announced a pivotal policy on the use of Artificial Intelligence (AI) in the judicial system, emphasizing that AI will serve as a supportive tool rather than replacing judges. This initiative aims to enhance the efficiency of court proceedings through the utilization of AI for tasks such as case allocation, statistical reporting, and legal analysis. However, strict restrictions are in place, prohibiting AI from influencing critical judicial decisions like bail or sentencing. Additionally, AI cannot assess evidence credibility or witness testimony. Privacy safeguards prohibit public AI platforms from disclosing personal data related to cases. Judges and court officials are mandated to verify any AI-generated legal references through authoritative sources, assuming full responsibility for their decisions. Errors made by AI will not be considered valid defenses, and violations of policy will incur disciplinary measures. Training on AI advancements will be obligatory for judicial officers, adhering to the Digital Personal Data Protection Act, 2023.
