The Calcutta High Court has ruled that IndiaMART’s exclusion from ChatGPT is indicative of “selective discrimination” against the B2B platform. IndiaMART, a major Indian online marketplace connecting buyers and suppliers, alleged that OpenAI consciously omitted its listings from ChatGPT while including competitors. Justice Ravi Krishan Kapur noted the lack of logical justification for this exclusion. OpenAI and ChatGPT failed to appear for the hearing, despite being notified. IndiaMART’s counsel argued that the exclusion is unjust, citing a US Trade Representatives (USTR) report and highlighting that other entities accused of wrongdoing remain visible. The court acknowledged potential reputational and commercial harm to IndiaMART but opted not to grant interim relief, emphasizing the need for OpenAI to respond. The case is set for a follow-up hearing on January 13, 2026. This situation raises important questions regarding fair representation and competitive practices in digital platforms.
