In a recent legal battle, X and xAI faced setbacks in their antitrust lawsuit against Apple and OpenAI. The case stems from Elon Musk’s claims that Apple’s integration of ChatGPT hinders other AI apps. A U.S. magistrate judge denied X and xAI’s request for OpenAI’s source code, deeming it irrelevant to their claims and excessively intrusive under Rule 26. Despite the plaintiffs’ desire to challenge OpenAI’s technical assertions about integrating Grok into Apple devices, the court emphasized that less intrusive methods exist for gathering evidence. The judge expressed frustration over the numerous excessive discovery requests made by X and xAI, with over 135 entries in the docket within just five months. Additionally, a recent request for documents from South Korea’s Kakao super app was also denied for being overly broad.
