Tesla CEO Elon Musk’s ketamine use may not be discussed during his upcoming trial against OpenAI, as US Judge Yvonne Gonzalez Rogers deemed it irrelevant. The trial, set to begin April 28 in Oakland, focuses on Musk’s claims that OpenAI misled him about its nonprofit intentions after his $38 million donation. Musk is seeking up to $134 billion in damages from OpenAI and Microsoft. The judge restricted OpenAI’s lawyers from raising ketamine-related questions unless they present compelling evidence linking it to Musk’s negotiations. However, she allowed limited questioning about Musk’s attendance at Burning Man, a venue known for drug use. Judge Rogers expressed skepticism regarding Musk’s expert witness financial economist, C. Paul Wazzan, who estimated Musk’s potential damages. The trial is expected to feature testimony from several tech industry leaders, and unusual for high-profile cases, expenses such as the jury’s lunch will be paid by both parties.
