OpenAI has accused Elon Musk of attempting a “legal ambush” by changing his lawsuit objectives just weeks before the trial. Musk’s lawsuit against OpenAI and Microsoft, filed in 2024, alleges that OpenAI strayed from its founding mission as a research institution by accepting significant investments and becoming a for-profit entity. With a trial scheduled for April 27, Musk initially sought $79 billion to $134 billion in “wrongful gains,” referencing OpenAI’s skyrocketing value since its founding in 2015. Recently, Musk’s legal team proposed that any damages awarded should go back to OpenAI, while also calling for OpenAI’s restructuring to be reversed and for CEO Sam Altman to be removed. OpenAI’s response deemed these last-minute proposals “legally improper,” asserting that the changes require entirely different evidence and witnesses. The ongoing legal battle continues to attract significant attention in the tech industry.
