Summary of Recent Executive Order on AI Regulation
On December 11, 2025, an executive order signed by President Trump aims to limit states’ ability to regulate artificial intelligence (AI). While largely criticized, there are some noteworthy points:
- Child Safety Protections: The EO explicitly allows states to continue enforcing laws against AI-generated child sex abuse material (AI-CSAM).
- Hands-Off Approach: This direction grants states the freedom to tackle child safety issues concerning AI chatbots without federal interference.
- Legislative Recommendations: Section 8(a) mandates senior officials to suggest federal guidelines that may preempt state laws, but Section 8(b) protects certain state laws, including those related to child safety.
Despite the broader intent to streamline AI regulation, states have significant leverage to safeguard their residents. As public demand for AI regulation grows, particularly surrounding child safety, states are more committed than ever to take action.
